The Court of Protection was brought into existence by the Mental Capacity Act of 2005.

It is intended to ensure that the best interests of people who lack the mental ability to makes decisions.

The Court of Protection appoints other people to make decisions, and makes decisions in some circumstances for people who lack the capacity to do this for themselves. Such decisions concern property and financial affairs, and the healthcare and personal welfare of adults who lack capacity. Decisions are also sometimes made for children.
